1. Acceptance and Scope

These Terms of Use (“Terms”) govern your use of truechoicepathways.com, including its pages, forms, scheduling features, downloads, links, and other Website content.

The Website is owned and operated by Mardex Enterprises LLC, doing business as True Choice Pathways (“True Choice Pathways,” “we,” “us,” or “our”).

By using the Website, you acknowledge these Terms and our Website Privacy Policy. If you do not agree, please discontinue use.

These Terms apply to Website use only. Actual services are governed by separate written service agreements, authorizations, and other applicable service documents. 

2. About True Choice Pathways

True Choice Pathways provides information and services related to California’s Self-Determination Program, including person-centered planning, pre-enrollment transition support, Independent Facilitation, individual-budget support, and spending-plan development.

True Choice Pathways is an independently owned provider. We are not employed by, controlled by, endorsed by, or acting on behalf of the California Department of Developmental Services, any Regional Center, Financial Management Services provider, service coordinator, or governmental agency.

Vendorization, authorization, referral, payment, cooperation, or inclusion on a provider list does not create an employment, agency, partnership, sponsorship, or endorsement relationship. 

3. Participant Choice and Accessibility

Participants remain at the center of decisions concerning their goals, services, supports, providers, budgets, and spending choices.

True Choice Pathways may explain options, organize information, support planning and communication, and assist participants in expressing their preferences. We do not replace the participant as the decision-maker.

Participants may use trusted supporters, family members, interpreters, advocates, assistive technology, guardians, conservators, or authorized representatives when appropriate.

We welcome individuals with disabilities and reasonable requests for communication assistance, alternative formats, or other accessibility accommodations. 

4. General Information Only

Website content is provided for general educational and informational purposes and is not individualized legal, medical, psychological, clinical, tax, accounting, investment, insurance, or public-benefits advice.

Program rules, Regional Center practices, rates, forms, timelines, and policies may change. Important or time-sensitive information should be verified with the appropriate official source or qualified professional. 

5. Consultations, Calendly, and When Services Begin

True Choice Pathways uses Calendly, a third-party scheduling service, to allow visitors to schedule consultations.

Scheduling an appointment, using Calendly, submitting a form, calling, emailing, receiving general information, or participating in an introductory consultation does not create a client or service-provider relationship and does not authorize billable work.

Services begin only after, when applicable:

  • True Choice Pathways confirms that the service is within our scope and capacity; 
  • A required written service agreement has been completed; 
  • Required consent, authority, or funding documentation has been received; 
  • Any required Regional Center or other written service authorization has been received; and 
  • True Choice Pathways confirms the service start date. 

A referral, vendorization, verbal approval, anticipated authorization, or notice that an authorization is being prepared does not, by itself, authorize services or billing.  

True Choice Pathways may decline an engagement when permitted by law, including because of capacity, scope, lack of authorization, conflicts of interest, or unresolved safety concerns.

6. No Guarantees

True Choice Pathways does not guarantee:

  • SDP eligibility or enrollment; 
  • Regional Center or waiver funding; 
  • A particular individual budget; 
  • Approval of a spending plan, provider, service, or purchase; 
  • Issuance or continuation of an authorization; 
  • Payment by a Regional Center or FMS; 
  • Completion by a particular date; 
  • Provider availability; or 
  • Any particular outcome. 

DDS, Regional Centers, FMS providers, government agencies, and other responsible organizations make their own decisions under applicable laws, policies, authorizations, and individual circumstances. True Choice Pathways does not control those decisions. 

7. Privacy and Sensitive Information

Our Website Privacy Policy explains how information collected through the Website and scheduling services is handled.

Please provide only information reasonably necessary for your inquiry or appointment.

Do not submit through Website forms, Calendly, or ordinary email:

  • Social Security numbers; 
  • UCI/client numbers; 
  • Bank or payment-card information; 
  • Passwords or login credentials; 
  • Government identification documents; 
  • Detailed diagnoses or medical records; 
  • IPPs, IEPs, or Regional Center records; 
  • Conservatorship or guardianship documents; 
  • Financial, benefits, tax, payroll, or employment records; or 
  • Other highly sensitive personal information. 

Contact us first if sensitive documentation is necessary so an appropriate transmission method can be discussed.

Electronic communications and third-party scheduling systems cannot be guaranteed completely secure. 

Children under 13 should not directly submit personal information through the Website or scheduling system. A parent, guardian, or other legally authorized adult may contact us concerning services for a child.

8. No Emergency or Crisis Services

The Website, Calendly, email, contact forms, telephone, and voicemail are not monitored continuously and should not be used for emergencies.

True Choice Pathways is not an emergency-response, crisis-response, medical, law-enforcement, Adult Protective Services, Child Protective Services, or immediate-intervention service.

For immediate danger or a medical emergency, call 911 or the appropriate emergency service. Concerns involving suspected abuse, neglect, exploitation, or other reportable matters should be directed to the appropriate authority or reporting channel.

Nothing in these Terms limits legally required reporting obligations. 

9. Acceptable Website Use

You may use the Website for lawful personal, family, educational, and informational purposes.

You may not:

  • Violate applicable law or another person’s rights; 
  • Misrepresent your identity, qualifications, authority, or affiliation; 
  • Submit fraudulent, threatening, harassing, discriminatory, defamatory, obscene, or unlawful material; 
  • Introduce malware or harmful code; 
  • Interfere with Website operation or security; 
  • Attempt unauthorized access to systems or data; 
  • Collect another person’s personal information without lawful authority; 
  • Impersonate True Choice Pathways or another person or organization; 
  • Use automated scraping or data-mining tools without permission; 
  • Copy, reproduce, sell, commercially exploit, or create derivative works from Website content without authorization; 
  • Use our branding in a way that falsely suggests endorsement or affiliation; or 
  • Use the Website for spam or unauthorized solicitation. 

 

10. Intellectual Property

The Website’s original text, graphics, logos, branding, layout, downloads, and other original materials are owned by or licensed to Mardex Enterprises LLC and are protected by applicable intellectual-property laws.

True Choice Pathways, associated logos, and our branding may not be used in a way that creates confusion or falsely suggests sponsorship, affiliation, approval, or endorsement.

You retain ownership of original information you submit, but authorize us to use it as reasonably necessary to respond to your inquiry, provide requested services, maintain security, comply with law, and carry out purposes described in our Privacy Policy.

Do not submit material belonging to another person unless you have permission or lawful authority. 

11. Third-Party Services and Links

The Website may use or link to third-party services, including:

  • Calendly; 
  • GoDaddy; 
  • Regional Centers; 
  • DDS and other government agencies; 
  • Financial Management Services providers; 
  • Community organizations; and 
  • Other service providers. 

Third parties have their own terms, privacy practices, accessibility practices, security measures, cookies, and technologies.

True Choice Pathways does not control independent third-party services and is not responsible for their content, availability, privacy, security, or accessibility.

Links and collaborative relationships do not necessarily constitute endorsement, affiliation, or recommendation. 

Testimonials, examples, timelines, checklists, and hypothetical situations are illustrative only. Individual circumstances and results vary.

12. Website Availability and Limitation of Liability

The Website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee that the Website or third-party scheduling functions will always be uninterrupted, error-free, completely secure, current, or compatible with every browser, device, or assistive technology.

To the fullest extent permitted by law, Mardex Enterprises LLC, True Choice Pathways, and their owners, managers, employees, and authorized representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from:

  • Use or inability to use the Website; 
  • Reliance on general Website information; 
  • Temporary Website or scheduling unavailability; 
  • Use of a third-party website or service; or 
  • Unauthorized interception of electronic communications outside our reasonable control. 

These Website limitations do not replace duties accepted under a separate signed service agreement.

Nothing in these Terms excludes responsibility or rights that cannot lawfully be excluded or waived. 

13. California Law, Disputes, and Nonwaivable Rights

These Terms are governed by the laws of the State of California, except where federal or other mandatory law applies.

Before filing a lawsuit concerning Website use or these Terms, the parties are encouraged to provide written notice and make a good-faith effort to resolve the matter informally for at least 30 days, unless immediate relief is reasonably necessary.

Where legally permitted, legal proceedings relating to these Terms or Website use shall be brought in the appropriate state court in San Diego County, California, or the United States District Court for the Southern District of California.

Nothing in these Terms prevents anyone from contacting or filing a complaint with DDS, a Regional Center, FMS provider, clients’ rights advocate, disability-rights organization, government agency, law-enforcement agency, court, or other appropriate authority.

Nothing waives rights that cannot legally be waived, including applicable consumer-protection, privacy, disability-access, civil-rights, public-benefit, participant-choice, or Self-Determination Program rights.

If any provision is unenforceable, the remaining provisions continue in effect. 

14. Changes and Separate Service Agreements

We may revise these Terms when our Website, services, scheduling tools, technology, laws, programs, or business practices change.

Updated Terms will be posted with a revised Last Updated date.

These Terms and our Website Privacy Policy govern Website use. They do not replace a signed service agreement, Regional Center authorization, consent form, release of information, person-centered planning agreement, payment agreement, or other service document.

If a signed service agreement conflicts with these Terms regarding actual services, the signed service agreement controls for those services.
